Terms & Policies of Perfect Home Control
Product:
In the event that a particular item is discontinued or not longer available by the manufacturer, Perfect Home Control, Inc. will replace the product with an item of equal or superior performance.
Pricing:
Quotation pricing is fixed. However, prices may change due to
market fluctuation or manufacturer decisions. This can result in lower but
also higher pricing to you, our valued customer. In case of a price increase
you can cancel your order without any cost. Manufacturer specifications are subject to change without notice.
Shipping:
We will ship all orders immediately based on product availability. Standard method of shipping is UPS Ground. 3-day shipment, overnight and Saturday delivery are also available at additional cost, please ask for price info. When there is any backorder, we will inform you in time. We do not ship to Hawaii and Alaska.
Shipping cost:
The amount of shipping cost will be included in your total.
Insurance:
Orders under $100 are automatically insured by UPS. All products over $100 are insured through Perfect Home Control, Inc. and the amount is included in your total. Perfect Home Control, Inc. is an insured company.
Payment:
We accept MasterCard and VISA with no additional charge for credit card payment. We also accept orders with prepaid bank certified check or money order. Merchandise in combination with an installation needs to be paid immediately after the first installation day by check or credit card. No shipments will be made on any past due account. A deposit of 25% of the total amount is required from the client upon acceptance of this proposal. This deposit will allow Perfect Home Control, Inc. to order all products needed for the initial stage of the project. All equipment, wire, parts and labor must be paid in full at the first day of installation. If collection or enforcement of this agreement is necessary, the defaulting party is liable for all costs incurred in connection therewith.
Drop-shipments:
Orders can be shipped directly to your home-/job-site as requested. Please make sure that someone will be available to sign for the package(s) or arrange for a signature release on file with the carrier. Special orders, large orders and urgent orders also can be drop shipped directly from the manufacturer to your location. Although Perfect Home Control, Inc. does not charge for drop shipments, you will be billed separately for any incurred drop ship fee and shipping cost, either from Perfect Home Control, Inc. or the supplier.
Refusals:
Any refused or undeliverable orders will be charged shipping fees and a restocking fee of 30% of the invoiced amount. UPS demand a $10 address correction fee, which Perfect Home Control, Inc. will bill you for if an incorrect address is given at time of order. This includes, but is not limited to, incorrect street address, missing suite or apartment number or incorrect ZIP code. To avoid both this $10 charge and shipping delay, please confirm precise shipping information at time of order.
Billing/Shipping Discrepancies:
Shipping and billing discrepancies (misshipped items, missing items, incorrect charges, etc.)
must be brought to our attention within 5 days of receiving the shipment. Damaged in shipping: Every effort is made to pack your goods to prevent damage during shipping. However, if a product is damaged, you must notify Perfect Home Control, Inc. within 5 days of receiving the shipment. UPS reserve the right to inspect packaging and damaged products. Credit may not be issued if packaging is not available for inspection. If your delivery arrives visibly damaged, please ask the carrier to make a note of the damage at time of delivery. Damage claims will not be paid unless damage is indicated on freight bill. Plasma, LCD or Projector TV's might have to be returned to the manufacturer. Please call for info.
Defective out-of-box returns:
Perfect Home Control, Inc. make every attempt to deliver your product in best condition, however in single cases a product might arrive damaged or defective. Subject to the product manufacturer warranty requirements, defective products will be replaced, if returned to us/manufacturer within 15 days of the invoice date. Defective products must be returned in the manufacturer’s original packing, and the carton must include all components and other items originally packaged with the product, including all manuals, cables, remotes etc. Do not write on the product packaging or use it as a shipping box. You pay shipping to us, and we will pay for domestic return shipping to you via UPS Ground. Installed Plasma / LCD TV’s showing minor defects first may have to be checked by a certified technician of the manufacturer to decide on either a product exchange or complete return to the manufacturer.
All returns:
You must return all of the items within 15 days from the date of purchase. During this 15 day period, all new and unused products that are currently manufactured, in their original packaging with all hardware and manuals, and in resellable condition, can be returned with a restocking fee of 30% of the invoice amount, you must pay shipping to us. If products do not meet this criteria, in most cases, they cannot be returned or are subject to a higher restocking fee. TV´s (Plasma-, LCD-, Projector- etc.) are not returnable at all and all sales are final. Dissatisfaction with product due to misinterpreted features, appearance, performance etc. are not a reason for any exchange or return. Due to copyright laws, software, books, and manuals are not returnable. Wires or cables are also not returnable. Shipping charges are not refundable and returns must be sent to Perfect Home Control, Inc. or the manufacturer, freight prepaid. Perfect Home Control, Inc. is not responsible for returns lost or damaged during shipping. Our RMA request form must be completed before an RMA number is issued. To obtain an RMA request form, download one at http://www.perfecthomecontrol.com/RMA%20Template.pdf in .pdf format. If you cannot open this type of document please go to www.adobe.com and download Acrobat Reader free of charge. When you return a product, you must write the RMA number on the outside of the package, not on the manufacturer’s box. RMA numbers are valid for 15 days from date of issue. Returns without an RMA number on the box will be refused. Note: There are no returns on special order merchandise like Plasma, LCD or Projector TV’s. Please verify compatibility and customer commitment prior to ordering these items.
Installations:
Perfect Home Control, Inc. tries to give the best possible
estimate of labor hours needed for your installation, whether it be after a
personal visit to the installation site or just according to your information without having seen the location. However, problems might occur during installation like signal loss due to bad existing cabling, needed cables are missing and additional cables need to be run to the installation locations, access to installation locations are not sufficient, wall structures are not within normal parameters etc. that might add additional working time. In such a case we will inform you at that point of time about these problems. Locations for Plasma and LCD TV´s can be chosen by you. However, these locations may vary due to support structures in the wall like stud locations, electrical high voltage wires and other circumstances that prevent an exact location of the unit. If furniture or other objects need to be moved to make an installation possible we ask you to do this in advance. If you are not able to do this because of your physical condition we can do this at the day of installation. This however will add additional labor time and Perfect Home Control, Inc. is not responsible for any damage to these moved furniture or
items. Perfect Home Control, Inc. require a minimum of 48 hours notice of cancellation prior to a scheduled installation and may charge a penalty for lost revenue associated with the lack of notice.
Safety and Insurance
Perfect Home Control, Inc. is a registered and insured company. Installations will comply with all applicable safety standards recommended for residential houses / commercial buildings. A copy of the insurance document can be requested in written form from the Office Manager, Anja Hartwich at ah@perfecthomecontrol.com or by fax at (239) 573-9601.
Guarantee and Repairs
Perfect Home Control, Inc. guarantee that all major devices / components used for structured wiring are original high-quality ONQ-Legrand market leader products unless stated otherwise. Technical Equipment beyond wiring, i.e. TV´s, Receivers, Speakers etc. and their function can only be warrantied according to the manufacturer’s guidelines. Perfect Home Control, Inc. guarantee that all wiring / cabling services will be executed only by well-trained employees. We provide a 2-week guarantee after installation and final check on all cabling and wiring. Damages of wiring and technical equipment occurring through wrong usage and/or hook-up by operator will not be covered at all by us and will be at residence owner’s expenses. Maintenance, repair or alteration of the installed cabling / wiring are to be seen as a separate beyond-contract-service at further cost. Perfect Home Control, Inc. honor all manufacturer´s warranties. However, manufacturer´s do not pay for any labor charges associated with the removal or re-installation of any product. Please ask for a potential extended warranty including an in-home service provided by the manufacturer.
Privacy Policy:
Perfect Home Control, Inc. will not use or sell your email address or personal data to any 3rd party, with the exception that if Perfect Home Control, Inc. sell the majority of its assets or business, it may provide this data to the purchaser of the business so that they can continue providing service to our customers.
Miscellaneous:
In the case that any portion of this agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intensions of the parties and the remainder of the provisions shall remain in full force and effect. Our failure to insist upon or enforce strict performance of any provisions of this agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between parties nor trade practice shall act to modify any provision of this agreement. This agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute relating in any way to our webpage or to products you purchased from Perfect Home Control, Inc., shall be submitted to arbitration Fort Myers, Florida, without regard to conflict of law probations. Arbitration under this agreement shall be conducted under the rules of the American Arbitration Association. We shall not be liable or deemed to be in default for any delay or failure in delivery under this agreement resulting directly or indirectly from acts of God, civil or military authority, acts of public enemy, war, riots, civil disturbances, insurrections, accidents, dire, explosions, earthquakes, floods, the elements, strikes, labor disputes, shortages of suitable parts, materials, labor or transportation or any cause beyond our reasonable control. In no event shall Perfect Home Control, Inc. be liable to any person for any damages of any kind, including, without limitation, those resulting from loss of data, loss of use, loss of profits, or other damage, in connection with any of our products and services, including all information, products and services, that are referenced or linked to the Perfect Home Control, Inc. webpage or any other information, software, products, downloads, documents, advice and information provided by Perfect Home Control, Inc. Venue for litigation of any dispute, controversy, or claim arising out of, in connection with, or in relation to this agreement, or the breach thereof, naming us as the defendant, shall be proper only in a court of Fort Myers, Florida. You consent to the exclusive jurisdiction of that court. In any action between us and User to enforce any of the terms of this agreement, we shall be entitled to recover expenses, including reasonable attorney’s fees. This agreement constitutes the entire agreement between Perfect Home Control, Inc. and the customer.
